And many will drive, rent, or buy recreational vehicles for fun &#8211; from all-terrain vehicles (&#8220;ATVs&#8221;) and golf cars to off-road motorcycles and snowmobiles.  At the beginning of the winter season, we are therefore turning our attention to regulatory measures by the Consumer Product Safety Commission (\u201cCPSC\u201d) affecting recreational and commercial vehicles for this month&#8217;s issue of \u201cRecalls in Review\u201d.<span id=\"more-5679\"\/><\/p>\n<p>ATVs, recreational off-road vehicles (&#8220;ROVs&#8221;), and commercial vehicles (&#8220;UTVs&#8221;) are strictly regulated by the CPSC.  ATVs must comply with Federal Safety 16 CFR Part 1420, which is incorporated by reference into the American National Standard for Four-Wheel All-Terrain Vehicles (ASNI \/ SVIA 1-2017).  According to the federal safety standard, manufacturers, importers and \/ or dealers must have a <a href=\"https:\/\/www.cpsc.gov\/Business--Manufacturing\/Business-Education\/Business-Guidance\/ATV\/ATV-Action-Plan-List\">ATV action plan<\/a> with the CPSC before they can legally introduce or sell new, assembled or unassembled ATVs in the United States.  The CPSC publishes extensive guidelines too <a href=\"https:\/\/www.cpsc.gov\/safety-education\/safety-guides\/sports-fitness-and-recreation\/all-terrain-vehicle-safety\">ATV and ROV safety<\/a>, as well as <a href=\"https:\/\/www.cpsc.gov\/s3fs-public\/2020_Report_of_Deaths_and_Injuries_Invovling_Off_HighwayVehicles.pdf?imC.TJWgDuptE5LCrTj9lkE08Vo3Nu4g\">Reports of deaths and injuries<\/a> with off-highway vehicles and some <a href=\"https:\/\/www.cpsc.gov\/s3fs-public\/541.pdf\">Instructions on snowmobiles<\/a>.  There are voluntary industry safety standards for snowmobiles (SAE J 1222-2012; SAE J 1038-2020) and golf cars (ANSI \/ OPEI Z130.1-2020) &#8211; two other products that are also frequently the subject of CPSC recalls.<\/p>\n<p>At least 214 recalls of recreational and commercial vehicles have been carried out by the CPSC since January 2011. The recalls also concerned off-road motorcycles for closed circuits \/ competitions (11%), snowmobiles (11%), golf carts (9%), some &#8220;<a href=\"https:\/\/www.cpsc.gov\/Recalls\/2018\/Monster-Moto-Recalls-Mini-Bikes-Due-to-Fire-Hazard\">Minibikes<\/a>&#8220;, a <a href=\"https:\/\/www.cpsc.gov\/Recalls\/2017\/Hammerhead-Off-Road-Recalls-Fun-Karts\">Offroad fun kart<\/a>, and a <a href=\"https:\/\/www.cpsc.gov\/Recalls\/2015\/Gibbs-Sports-Amphibians-Recalls-Quadski-Amphibious-Vehicles\">Amphibious vehicle<\/a>.<\/p>\n<p>The CPSCs <a href=\"https:\/\/www.cpsc.gov\/Newsroom\/News-Releases\/2021\/Gear-Up-Limit-Riders-and-Keep-ATVs-and-ROVs-Off-Roads\">June 2021 guidelines<\/a> on ATV and ROV safety states that children are at higher risk in these vehicles, especially when children are driving adult sized vehicles or when more than one passenger is traveling in a vehicle built for a single driver.  The CPSC reports that children under the age of 16 are responsible for the third highest percentage of ATV-related deaths by age group.  It is noteworthy that almost all recalls of recreational and commercial vehicles since January 2011 are for general (or adult) vehicles. The problems that pose an accident risk vary widely in the recalls, including problems with: the steering system or loss of steering function, the brake assemblies or the parking brake, the throttle, the clutch, the wishbones, the shock absorbers, the wheels, the software or the electrical systems, and more.<\/p>\n<p>Another 41 percent of the recalls concern fire and burn risks.  These hazards typically relate to oil \/ fuel leaks caused by problems with the fuel tank, fuel line \/ hose, other fuel pump system components, turbocharger, exhaust manifold, other exhaust system components, mufflers, and heat shields.  Two of the recalls for youth vehicles, both in 2015, dealt with issues with the components of the fuel system that could cause leaks (<a href=\"https:\/\/www.cpsc.gov\/Recalls\/2016\/BRP-Recalls-Youth-All-Terrain-Vehicles\">Youth Quad<\/a>, <a href=\"https:\/\/www.cpsc.gov\/Recalls\/2015\/Polaris-Recalls-Youth-RZR-Recreational-Off-Highway-Vehicles\">Youth ROV<\/a>).<\/p>\n<p>The remaining three recalls of youth ATVs were all made because the vehicles did not meet the requirements of the mandatory federal safety standard for ATVs, including the maximum speed limits. Accordingly, the remedy offered by almost all recalling companies is a free repair of the defect in question, rather than a refund or a replacement product.
